Article 3. Applicability
These terms apply to every offer from ViaScripta and to every agreement between ViaScripta and the Customer.
Article 4. The Offer
- Every offer states what the Customer receives, what it costs, and which rights and obligations are attached to it.
- If an offer includes a price or description that is clearly based on an error, ViaScripta is not required to deliver the product. The amount paid will be refunded.
- Current prices are listed in the app. The website lists the subscription prices and the starting price of session packs.
Article 5. The Agreement
- The agreement is formed at the moment the Customer accepts the offer.
- ViaScripta confirms the agreement by email right away. That confirmation includes the invoice, these terms, and the model withdrawal form.
Article 6. Free Trial
- When creating an account, the Customer receives seven days of access to all features, including the full Course Library, and seven Free Sessions. These Sessions can be used in the Writing Coach and for Writing Exercises.
- The trial period ends automatically and does not convert into a paid subscription. When it ends, access to the Course Library expires and unused Free Sessions expire. Analyses of the Customer’s own texts remain available in the account.
- If the Customer subscribes during the trial period, unused Free Sessions are retained. Unused Free Sessions expire when the subscription ends.
Article 7. Subscriptions
- A subscription gives access to the Writing Coach and, depending on the plan chosen, to the Course Library.
- Each subscription includes a fixed number of Sessions per month. These Sessions can be used in the Writing Coach and, to the extent the subscription gives access to the Course Library, for the Writing Exercises in those Courses. Sessions that have not been used by the end of the month expire.
- A subscription runs from month to month and can be canceled on a monthly basis. Cancellation is done through the user account.
- After cancellation, the subscription ends at the end of the current period.
- The Customer can switch to a different subscription. The change takes effect at the start of the next period. Sessions from the current month remain available until then. At the start of the new period, unused Sessions expire and the Customer receives the number of Sessions that comes with the new subscription.
- When the subscription ends, access to the Writing Coach and the Course Library expires. The account, the submitted texts, the Analyses of the Customer’s own texts, and Purchased Courses are retained.
- Money-back guarantee: within 30 days after the first payment for a new subscription, the Customer can ask for a full refund of that payment, without giving a reason and regardless of how many Sessions have been used. The Customer sends the request by email to support@viascripta.com. ViaScripta refunds the amount within fourteen days through the original payment method, and the subscription ends at that moment. The guarantee applies once per Customer. It does not apply to later subscription payments, Session Packs, or Courses. It comes in addition to the right of withdrawal in Article 11.
Article 8. Session Packs
- The Customer can buy individual session packs. The Sessions are available in the account immediately.
- Purchased Sessions are valid for one year from the date of purchase. Sessions are tied to an ongoing writing process. That is why the validity period is one year.
- The Customer receives a reminder one month before the expiration date.
- Purchased Sessions remain usable until their expiration date, even after a subscription ends, and even if they were bought at the subscription rate.
Article 9. Order of Deduction
- If the Customer has more than one type of Session, the Sessions are deducted in the following order: first any Subscription Sessions, then Purchased Sessions, then the remaining Free Sessions.
- For Writing Exercises in a Purchased Course, any Subscription Sessions are deducted first, then Purchased Sessions, then Course Sessions.
- Within each type, the oldest Sessions are deducted first.
Article 10. Courses
- Each Purchased Course comes with 100 Sessions, which can be used for Writing Exercises.
- These Course Sessions are valid for three years from the date of purchase and can be used only for Writing Exercises in Purchased Courses. If the Customer has bought more than one Course, the oldest Course Sessions are deducted first.
- A Purchased Course remains accessible for as long as the account exists. If the Customer deletes their account, access expires.
- A Course the Customer accesses through a subscription is part of that subscription. No Course Sessions come with these Courses; for these Courses, the Customer uses their monthly Subscription Sessions.
- If ViaScripta discontinues its services, it will give notice at least three months in advance. If, at that time, the Customer still has valid Sessions that they can no longer use, ViaScripta will refund the corresponding portion of the purchase price.
Article 11. Right of Withdrawal
- The Consumer has a cooling-off period of fourteen days, starting on the day after the agreement is concluded. This applies to subscriptions, session packs, and Purchased Courses. The Consumer does not have to give a reason. Notice of withdrawal can be given using the withdrawal button for the relevant purchase in the user account’s purchase history, using the form at the end of these terms, or by sending an email in which the Customer states that they are withdrawing from the agreement.
- ViaScripta confirms receipt of a withdrawal by email right away.
- Before each purchase, ViaScripta informs the Customer about the right of withdrawal and makes the model withdrawal form available. If it does not, the cooling-off period continues beyond fourteen days.
- For a subscription, ViaScripta asks the Consumer in advance to agree to the following: the subscription starts immediately, and if the Consumer stops early, the Consumer pays for what they have used. If the Consumer withdraws from the agreement within the cooling-off period, they owe an amount proportionate to the part of the agreement ViaScripta has performed, calculated on the basis of the agreed price.
- Before granting access to a Purchased Course, ViaScripta asks for express consent and for an acknowledgment that the Consumer thereby loses their right of withdrawal for that Course. Both are confirmed by email. Once access has been given, the right of withdrawal for that Course expires.
- With a session pack, the Sessions are available immediately. If the Consumer withdraws from the agreement within fourteen days, the Customer receives a refund of the portion of the purchase price that corresponds to the Sessions they have not yet used.
- Each Analysis and each Follow-up Question counts as a separate delivery. Before ViaScripta creates an Analysis for the first time, it asks for the Consumer’s express consent to begin delivery immediately and for an acknowledgment that the Consumer thereby loses their right of withdrawal for the Analyses and Follow-up Questions delivered afterward. ViaScripta confirms the consent and the acknowledgment by email.
- If, under Section 6.5.2B of the Dutch Civil Code, the right of withdrawal is excluded or does not apply for another reason, ViaScripta states this expressly with the relevant offer.
- This article applies only to Consumers. There is no right of withdrawal for a business purchase.
Article 12. Prices and Payment
- Prices are in US dollars and do not include sales tax, VAT, or other taxes. Where the law requires ViaScripta to charge such a tax, it is added at checkout and shown before the Customer pays.
- Payment is made at the time of purchase. For a subscription, the amount is charged automatically every month. If the Customer makes the first payment with iDEAL, they thereby grant a direct debit mandate for their bank account. If they pay with a payment card, that card is charged every month.
- If a payment fails, the Subscription Sessions are blocked until the payment has been made. The Customer has fourteen days to make it. After that, ViaScripta suspends access.
- ViaScripta may change the price of a subscription. It will give notice at least one month before the change takes effect. The Customer can cancel before the new price takes effect.
Article 13. The Customer’s Texts
- The texts the Customer submits continue to belong to the Customer. ViaScripta acquires no rights to them whatsoever, except the right to process them in order to deliver the Analysis, to resolve an issue the Customer reports, and to improve the coaching in the manner set out in paragraph 4.
- The Customer’s texts are not visible to other users. ViaScripta does not read them and does not check their content. ViaScripta opens a text only when the Customer reports an issue that cannot be diagnosed any other way.
- ViaScripta stores texts and Analyses for as long as the account exists. The Customer can delete a text themselves at any time. If the Customer deletes a text or their account, everything connected to it is removed: the text itself, the Analyses, the Follow-up Questions, and the data derived from them.
- To improve the coaching, ViaScripta looks at patterns across Analyses: how often certain types of comments occur. This is about counts and categories, not the content of the text.
- ViaScripta uses an external AI service to generate Analyses. ViaScripta does not use the Customer’s texts to train models. Nor does the service it uses. The Privacy Policy describes this in more detail.
- Within thirty days, the text is removed from the AI service that creates the Analysis. This happens automatically and is independent of when the Customer deletes their text or account.
- Legal obligations take precedence over the provisions of this article.
Article 14. Nature of the Service
- ViaScripta assesses the submitted text, not the complete work of which that text is a part.
- An Analysis is ViaScripta’s assessment, not a definitive judgment of the quality of the text. Other readers may reach a different judgment.
- ViaScripta does not rewrite texts.
Article 15. Availability
- ViaScripta endeavors to keep the service available, but cannot guarantee that it will always work without interruption.
- ViaScripta may temporarily take the service offline for maintenance or improvement. ViaScripta keeps the interruption as short as possible.
Article 16. Use of the Account
- The account is personal. Login credentials are not to be shared with third parties.
- In the event of misuse, ViaScripta may suspend or delete the account.
- If the Customer uses the service for criminal purposes, ViaScripta may suspend or delete the account.
Article 17. Liability
- ViaScripta is not liable for indirect damages. These include, but are not limited to, lost profits, lost contracts, lost savings, reputational damage, and damage due to business interruption.
- ViaScripta is not liable for the consequences of following an Analysis. Analyses are suggestions. The quality of a text cannot be determined objectively. ViaScripta does not guarantee any result.
- ViaScripta is not liable for damage resulting from incorrect or incomplete information provided by the Customer, or from use of ViaScripta in violation of these terms.
- These limitations do not apply if ViaScripta caused the damage intentionally, or if it acted so carelessly that it should have known that damage could occur.
Article 18. Complaints
- Complaints can be submitted to support@viascripta.com.
- ViaScripta responds in writing within five business days.
- If ViaScripta and the Customer cannot resolve the matter together, the matter can be brought before the courts.
Article 19. Applicable Law
- This agreement is governed by Dutch law.
- If ViaScripta directs its services at Consumers in another country, the Consumer may also rely on the mandatory consumer protection law of that country.
Article 20. Changes to These Terms
- ViaScripta may change these terms.
- For an ongoing subscription, amended terms do not apply until the end of the current period.
- If the terms change during the period in which an offer is valid, the provision most favorable to the Consumer applies.
